Diana Jo James (Oxley) was born to Marian Opal Huddleston and Bill (Willis) Oxley on August 14th 1951 at Memorial hospital in Vancouver, Washington. She was their first born child to survive, which laid a foundation of strength for the life ahead of her. She would later have a total of two full siblings and five half-siblings, all of whom with the exception of one, she was tasked with raising while her parents worked full time, which was uncommon during that era. She graduated from Evergreen High School in 1970. She married and delivered three children of her own, Megan, Melissa (stillborn) and Matthew.

Diana held many careers over the course of her life. She started at Taco Bell as a teenager and insisted that today’s Taco Bell made the tacos wrong and would always politely ask them to put the cheese before the lettuce so it melted every time she ordered. She worked as a housekeeper at timeshares around the country in her early adult life which required her young family to move every six months to a year. When she gave birth to her last child Matthew, she decided to move back home to Vancouver to be close to family and eventually divorced the children’s biological father after years of domestic, physical and emotional abuse. She took a housekeeping job at PeaceHealth Hospital when it was SW WA Medical Center but after carpel tunnel surgery she was forced to find a job with less physical demands. Inspired by her youngest twin sisters Debby and Shelly, Diana became a job coach to differently abled persons and found true passion in her work. She felt that she was able to make a difference in her community by helping companies and communities facilitate acceptance and embracing of differently abled people. She always viewed her twin sisters as amazing people deserving of that same acceptance, love and support. It was quite common in that era to institutionalize people with special abilities, but their Mom Marian never gave that even a first thought. Diana’s raising of her siblings gave her a unique and specialized skill set to be an advocate of special and gifted people with passion and joy. Diana later went on to meet Jim (James) McCann through a mutual friend and became engaged shortly after Thanksgiving in 1994 before Jim was tragically murdered at the hands of a jealous sociopath just days before Christmas that same year. Shortly after that time, she found herself being laid off from her job coaching position and needed a more stable career to singlehandedly support her two children as the sole provider. She went back to school and completely reinvented herself, learning computer skills that secured her a temporary position with the City of Vancouver in Accounts Payable from which she was later made a permanent employee. She also picked up many other side hustles including office cleaning which she used to teach her children the value of a strong and dedicated work ethic as they cleaned together as a family to make ends meet. She retired from the City of Vancouver after 16 years of service in 2016 after suffering a health setback.

She gripped both of our hands before it started and it ended when I whispered to her that there is love in letting go. đź’• We are devastated as we wake today without our mom in her earthly body. We are at peace knowing she is no longer suffering but we will miss her for the rest of our lives.đź’”

Ups and Downs

The last few weeks have been full of ups and downs. Our hearing with the ALJ was postponed and is now set for March….Looking forward to having our day in court with Humana. Humana continues to deny her medical claims, even at the current hospital. A couple of weeks ago Mom sang happy birthday to me….it was the most beautiful gift I’ve ever received! I cried big gator tears! She has been doing well with her therapies although she does exhaust easily. She has been engaged and answering questions. Her doctors have called her recovery an anomaly because they don’t see recoveries like hers 7+ months after injury. They consider her fully emerged from her coma, she doesn’t show signs of disorders of consciousness and isn’t showing signs of aphasia either. All really great things happening for her! She has been consistently improving until recently. Last week she had what is called “buried bumper syndrome” which is where the peg tube she receives her nutrition and medications through became dislodged. This happens in 3% of peg tubes. She went through surgery yesterday to replace that system and is on the mend from that. She also is now suffering from another case of pneumonia which has made her less responsive and unable to communicate effectively. Tonight she was transferred to ICU for monitoring and more immediate care. Our sincere hope is that she will improve in the next couple of days and be moved back to the floor she was on. As with all brain injuries, her recovery continues to ebb and flow. This week hasn’t been great but we are constantly reminding ourselves that she is still doing tremendously better than she was 2 months ago.

What a Difference 3 Weeks Makes

We have some really great news to share!! Wow, what a difference the last 3 weeks have made! It is very apparent that being sedated in Portugal definitely held her recovery back because our Mom is absolutely blossoming!!!!

Here is a list of 10 of Mom’s accomplishments in the last 10 days:

1. She has spoken her first words!
2. We think she can read!
3. She has memories!
4. She can laugh and smile!
5. She remembers people (even blew a kiss to her friend on a FaceTime call!!!)
6. She can engage in conversation most of the time and answer questions using her mouth or shaking her head.
7. Her personality and sense of humor is intact completely….she is definitely still smirking and cracking jokes!
8. She even sat on the edge of her bed today without much assistance!
9. She can tolerate having her trach capped and has had it downsized to the smallest size they go before they remove it!
10. She can pass items back and forth between her hands and even tried to brush her head when we handed her a brush!

We got a call from the doctor today on our way up to see her and they are reengaging PT, OT, and SLT because she is doing so well! This lady you guys…..She is kicking ass and taking names!!! We are so proud of her and her accomplishments!!!!!

Humana Denial of Medical Coverage

We really can’t even make this shit up!!! You might be asking yourself how it’s even remotely possible that Humana could deny her medical coverage in a US Hospital, especially with this being the first time she is actually receiving medically necessary care….and you’re not wrong! We are just as perplexed. If I was a betting woman, I would bet that she is somehow flagged in their system now to deny any claims that come in. It’s baffling!!! They outlined reasons why they are denying the coverage as she doesn’t fit their guidelines which include. 1. Lack of seizures. 2. High blood pressure not getting better with treatment. 3. Brain abnormalities that are new that show up on imaging. 4. New lack of mental clarity.

We have a very long road ahead of us fighting Humana to pay for her proper medical care. I hope they are ready, because they apparently haven’t learned that we don’t give up….we learned that from our mom!❤️

We did it!!!!!

Mom officially arrived back in Washington last night (12/11/2023) at 10:20 pm and was directly transported to the University of Washington in Seattle and admitted to the hospital for the medical care she has desperately needed for 7 months.  It feels surreal and we are over the moon to all be back in the same state!!!  Our hearts are full and our family complete again!

.As we continue to navigate this next chapter, our efforts to raise money and continue to advocate for her care don’t stop with the  plane arriving.  We will need to pay off the $144,000 medical repatriation loan to the federal government and we will need money for ongoing care and treatment Humana will likely fight against covering.  Please consider continuing to follow and share our story on social media, the website and here.

Call Sen. Murray’s Office Please

PLEASE…we need your help!

Please call Senator Murray’s office and leave a message imploring them to put pressure on the State Department to finalize this loan so we can Bring Diana James Home. Senator Murray’s phone number is (202) 224-2621, option 3 to leave a message.

Once again we are experiencing outrageous delays, this time with the state department. Since it became apparent that Humana is in no hurry to help our mom receive care, we have since filed a medical repatriation loan through Senator Murray’s office mid November. Last week on Monday we were told that “looks like we will be able to get her home today or tomorrow” by the Embassy. By Tuesday the Consulate reported experiencing a delay they were hoping would be resolved Wednesday. Thursday we were notified by the Consulate that the State Department was stepping beyond their purview and asking for medical records and more letters of medical necessity, which were all submitted with our loan application in November, 100’s of pages were submitted to support their 2 page loan document. This is a LOAN! When you go to the bank to get a car loan, they don’t ask you why you need a new car! This is well beyond their limits as they are not medical doctors able to determine medical necessity and actually goes outside of their own Foreign Affairs Manual (FAM). It even states in their manual that a US citizen in a coma or persistent vegetative state must be returned to the US for care.

We greatly appreciate anyone willing to make this phone call on behalf of our family.

Nov. 7 2023 | Maximus Update, Plea for Help!

We are desperately seeking your help to continue sharing our GoFundMe. We have exhausted our friends and family and need this to gain more traction with friends of friends of friends. We need the power of social media. We have sent out press releases and have been unsuccessful yet. We are working several angles and just need one of them to work out….and soon!

Mom has contracted her 6th and 7th hospital acquired infection, pneumonia and a UTI respectively. Pneumonia is very dangerous to someone in her condition. And because the public hospital she has been in for nearly 6 months now can no longer keep her, she is being transferred this week to a lower level hospital with even fewer resources.

October 28th | Humana denies appeal as not “medically necessary”

Humana upheld their original denial saying it’s medically unnecessary to bring her home, even though we have proven with the help of a clinical team and lawyers that it is absolutely necessary! Next step is Maximus to uphold or overturn, which claims to be an independent reviewer even though we aren’t in control of them receiving all the documentation. If Maximus upholds it them we will go before a law judge. Feeling very frustrated but also not surprised.

October 26th

Today marks the day we submitted our official appeal to Humana to try to get them to overturn their denial of the pre authorization for the medical repatriation of our mom. It was countless hours of an attorney and clinical team refuting and documenting every reason Humana denied the claim in the first place. It was countless hours of meetings, red tape, dedication and paperwork. It was submitting for Conservatorship of my mom and going before a judge to argue why I should hold such a power. It was serving aunts and uncles to notify them I was seeking conservatorship and it was only because the judge granted me limited Guardianship last Friday that I was able to submit an appeal to Humana on my mother’s behalf today. Did I mention that our mother is now battling pneumonia which makes her situation very dire?! Today marks the 72 hour clock that Humana has to approve or deny our appeal as we wait on pins and needles for their answer and my mom languishes in a hospital bed still not receiving the appropriate medical care she needs! Please send good vibes for Humana to make this situation right!

October 15th | Humana’s 2nd Denial

We received a denial from Humana to medically transport our mom back to the states to receive medically necessary care that she is unable to receive in Portugal. We have started working with an attorney to facilitate the appeal.

Every day our family wakes up and sees an hourglass dripping sand and time that we will never get back on her road to recovery. TBI patients need to receive treatment between 3-12 months to achieve the best possible recovery…..tomorrow we crest the 5 month mark. Sigh….

9/7/2023 | Back to the Beginning

As we wind down to closing this chapter before moving on to the next chapter in her recovery, we took a trip to the firehouse in the town where our mother fell ill and personally thanked the firefighters for saving our mom’s life. We would not have our mother if it hadn’t been for their quick action in taking her to a neighboring town’s hospital and not waiting for an actual ambulance. Sometimes words just aren’t adequate enough to express such profound gratitude and appreciation. We will forever be indebted to them for giving us more time with her in this life.

We then visited the park where she was before she lost consciousness and just took in the last sight she likely had before going into a coma.

One of these days we hope to be able to share her story with her….it is a story of survival and beating every odd stacked against her like the badass girl boss she has always been. Our love and admiration for her has only grown exponentially since this event, there is no end to our love for her.❤️. We are so fortunate to have such an incredible mother.

8/22/23 | A Big Leap!!!

A big leap!!!! Mom has been doing amazing lately! They found more fluid on her brain during the last CT scan and started steroids to see if that can clear it up, if it doesn’t she may require a shunt adjustment or possibly another surgery. They also found a hard to treat bacteria in her bladder, which apparently has been the cause of all of UTI’s. They started treating her with the antibiotics specific for this bacteria and she has now been one day in of having no catheter!!

But the biggest news we have to share is she has been awake pretty consistently for the last few days but today we met a milestone I have been waiting 14 weeks to see…..she SMILED!!! . That smile melted every part of my heart! She also started moving her head pretty regularly today….AMAZING!!!!I couldn’t be happier than I am today. I am so excited we are starting to see some significant improvements.

Now that she is awake, we are researching rehabilitation facilities to give her the best chance at a full recovery. We are eyeballing the Shirley Ryan Ability Lab in a Chicago Illinois as they are known to have one of the best neurological rehabs in the USA. We just have to get her accepted into their program and find a way home to the states. We definitely feel that clock ticking!!! ⏰. Thank you all for your love, thoughts, prayers and support.

8/14/23 | Diana’s Birthday Update!

Happy 72nd birthday to our mom, DIana Jo James! Thank you to all the Doctors, Nurses, and Staff for giving us another year to celebrate our mom! Thank you for saving her life!

Today is Mom’s birthday! She is 72 years old today. We celebrated by getting cake for all the doctors, nurses, staff and hospital friends who have played a pivotal role in her being alive today.

We invited Gil and his wife who was mom’s first roommate on the neurology floor. He kept watch over her during non visiting hours and prayed over her daily. He and his wife have become a second family for us, they speak not a lick of English but we have found ways to communicate with each other. Smiles and hugs really don’t need a language. They were so excited to see how well our mom is doing compared to when they last saw her.

We also invited Clara, another dear friend, whose mom was also a roommate to our mom for quite a while. Clara brought us bread, sent us recipes and wrote out key Portuguese phrases for us to learn. Her and her mom have the sweetest of hearts.

We invited Petra up from Hospital Administration as she has become a dear friend as well who has been crucial in helping us navigate this foreign hospital system and helping us in every way she could, even bringing Matt’s children some toys that her daughter had outgrown so his kids had toys to play with.

And of course her neurosurgeon, who did the surgery on our mom, and saved her life stopped by and enjoyed cake with us. The nursing staff is too busy to gather in one spot at the same time for a picture but ALL of these people have played a crucial role in helping our family navigate the biggest nightmare of our lives. They have helped us in ways we will never be able to adequately say thank you…but everyone loves cake and chocolate cake always says thank you. Happy birthday Mom and thank you to all of our friends (here and back home), who have helped us navigate such a difficult situation. All our love!

Update 8/4/23

Sorry it’s been a while since we have updated. Brain injuries take a significant amount of time to heal and things happen at a snails pace. She continues to do new things every week, which keeps us very hopeful for her recovery. She is battling another infection currently so those always tend to set her back a little bit.

The nursing staff has been stellar and we have really enjoyed helping them when they come in to take care of Mom. We’ve learned her physiotherapy routine, how to bath her and help change her when needed.

Today was a very hard day as Matt’s wife Miesha and their kids flew back home to the states. They should be just arriving back home actually. It was wonderful to have them here. A big thank you to Miesha for taking such great care of the caretakers! . Miesha also got to spend some time with Mom and the last couple of days we got permission for their oldest to come to see her grandma, which I think was enjoyed by both Grandma and Granddaughter. We miss them already! . This situation is just so tough!! It’s uprooted everything in our lives and turned it upside down….but our family roots are stronger and I know we will weather this storm just like we’ve weathered all the others….we are stronger together. If there is one thing that our family has learned….it is that.

Update 8/4/23

We have moved upwards of 15 times in the last 11 weeks…..hauling our luggage and our mom’s luggage from place to place, never feeling settled, and paying out the nose for Airbnb rentals. (What we have paid in temporary rentals, probably would’ve covered a furnished long term rental for 6 months or more!!). This entire experience would’ve been so much easier if we had a crystal ball and would’ve known the length or her recovery. Sigh….hindsight. We don’t have time for regrets in this situation, so onwards and upwards.

Our next big step is to secure a long term furnished rental! We need to be able to provide proof of wealth or passive income to rent an apartment here, which is difficult given that we have given up everything to be here. My brother has a small bit of passive income from his time in the military, Miesha (Matt’s wife) and Aaron (Megan’s life partner) are standing by and ready to help in whatever way they are able as well, I will be looking into getting a flexible job over here if I am able to work (but that is it’s own hurdle). We are going to really try to make it….but in combination of Mom’s care this is going to be super difficult.

July 9th, 2023

Sorry it has been a while since we have updated. Mom is doing alright. She has another UTI and she is being treated. Luckily they caught this one before it caused seizures. For that we are grateful. Every time she battles an infection, her body struggles to do 2 things at once (wake up from a coma and fight an infection), so she usually turns less responsive. We usually see her turn a corner after the infection is gone though.

We continue to battle the bureaucracy of our government who isn’t helping and we are exhausted. I am hoping to make an appointment with the Embassy in person this week to see if seeing a face behind the emails and phone calls gives them enough empathy to do their jobs. All in all, we have reached out to the Embassy 10 times in the last 8 weeks to no avail.

June 27th, 2023

We have updated our fundraising goal to $185,000 as our mother’s care needs have changed and she is no longer ventilated. This is the next step down and would provide her the following:

  • An ambulance flight in an air ambulance fitted with intensive care equipment
  • A medical staff (doctor and paramedic) on board
  • A ground transportation in an ambulance vehicle from the patient’s location to the departure airport, and then from the destination airport to the patient’s destination
  • Individual and personal care of the patient during the entire journey
  • 24/7 availability of your operations coordinator for any queries you may have
  • Regular updates on the progress of the ambulance flight
